Webinars on “School of future lawyer. Challenges of the qualification exam”

General information about the research group implementing the project

The team consists of four PhDs, including a practicing lawyer, a lawyer-supervisor of internships working in the Kyiv Bar Association, who have publications and experience in the field.


Short description of the project

The project aims to develop and conduct webinars on questions included in the qualification exam program approved by the National Bar Association (a new program is valid from January 1, 2020). The program includes general theoretical questions, as well as questions of substantive and procedural law, legal status of lawyers and their activity. The project will be implemented though training of future lawyers and recommendations to the councils in the regions; providing of amendments to the program of the qualification exam approved by the National Bar Association; development of questions, tests, practical cases; creation of individual accounts for persons who intend to obtain a practicing certificate with answers to questions from webinar participants. The webinars will also include the issues of tax relations and the implementation of administrative proceedings, the structure and principles of developing basic procedural documents, in particular:

  • tax audits in 2020 under the new rules (appeals against tax surcharges and tax advice; analysis of major legislative amendments and their impact on business);
  • litigation with tax authorities (subject and grounds for the claim; submission of evidence and assessment of their “belonging”; the importance of expertise to resolve tax disputes; the use of court decisions of the Supreme Court and the ECHR as arguments in the dispute);
  • financial liability (the principle of guilt-based liability for taxpayers; circumstances that release from liability; circumstances that mitigate liability; fines for non-registration (late registration) of tax invoices); decriminalization of economic crimes.

The most significant results achieved.

The questions included in the quali*fication exam program are analyzed; innovative methods and modern tools for the development of practical skills required for developing basic procedural documents are proposed; the case-law of the ECHR on the main questions of the program is systematized.
